General terms and conditions of sale · version 12 September 2026
These terms govern purchases made by consumers in the Azienda Agricola Miscasale shop. Before submitting your order, you can read the product information, check the total and correct the details you have entered.
1. The seller and how to contact us
The seller is Azienda Agricola Miscasale Società Semplice Agricola, with its registered office at Regione Miscasale 6, 14040 Montabone (AT), Italy; tax code and VAT number 01611300052. Legal form: società semplice (simple partnership); REA registration number AT – 129195; certified email (PEC) miscasale.ssa@pec.it. For orders, assistance, complaints and withdrawal: info@miscasale.com, telephone 0141 762534.
2. Products and delivery destinations
The shop sells the food products shown as available to purchase on their respective product pages, including biscuits, baked goods and flours. Wine is not sold online. Eggs can only be purchased at local markets and in the farm shop.
Delivery is available within Italy, to the addresses we serve as indicated during checkout. We do not offer international shipping through this shop. You can choose free collection from the farm, arranging a time with us, or free collection at one of the weekly markets listed in section 5. You do not need to live in Italy to purchase for delivery to an Italian address that we serve.
We produce in small batches according to the bakery’s needs. The stated shelf life of baked goods is four months from the packaging date, under the storage conditions indicated: this does not mean a guaranteed four months remaining from the day of delivery. The date shown on the packaging applies.
The shop does not offer customisable products. For any bespoke requests, please contact us directly: availability, specifications and terms are assessed separately.
Before ordering, check the ingredients, allergens, net quantity, pack size and storage information on the product page. Images are for illustration; the details for the specific pack purchased apply to its characteristics and food information. If any information is missing or you have any doubts, contact us before purchasing.
3. Prices, shipping and payments
Prices are in euros and include applicable taxes. The price per unit of measurement is also shown where required. Domestic shipping has a flat rate per order, regardless of weight, with a taxable amount of €10.00. The final cost includes applicable VAT, calculated by the shop according to the products ordered: for example, €10.40 with VAT at 4% or €11.00 with VAT at 10%. The actual shipping charge, including VAT, and the total are shown before you submit your order. There is currently no general threshold for free shipping.
The available payment methods are PayPal and Google Pay, according to the options actually displayed during checkout. Whether you can use a card through your chosen service depends on the options offered by the provider. We do not apply undisclosed surcharges for using a payment method.
Subsequent changes to prices or terms do not affect orders already concluded. In the event of an obvious error, we will contact you to clarify the situation, without unilaterally charging more than the amount you accepted.
4. Submitting and confirming your order
You can purchase with an account or as a guest. Select products, variants and quantities, enter the required details, choose delivery or collection and check the summary. The final button indicates that the order entails an obligation to pay.
After submitting your order, you will receive a message at the email address you provided. Merely receiving the request electronically does not amount to acceptance if the message states that further checks are still required. The contract is concluded when we confirm acceptance of your order or that we have started processing it. If an item is unavailable, we will inform you and refund without undue delay any amount already paid for the part not supplied; any substitutions require your agreement.
The confirmation contains the summary and a copy of the applicable terms that you can keep. Check that your contact details are correct and let us know about any errors. You do not need to print every website update to retain your rights.
5. Preparation, delivery and collection
Order preparation normally takes 1–2 working days from payment confirmation. When the parcel is ready, we book collection from the farm: the courier generally comes on the next working day, although collection may be delayed by a further day depending on its availability. These are preparation and collection times, to which transit to the recipient must be added.
The standard maximum time for dispatch, meaning the actual handover of the parcel to the courier, is 15 calendar days from payment confirmation. This allowance covers any preparation difficulties, equipment breakdowns or waits for collection; it does not change the usual times indicated above. If an issue arises that could cause this deadline to be exceeded, we will contact you promptly: any different time limits require agreement, and your statutory rights remain unaffected.
After collection from the farm, the courier normally delivers within 48 hours. Islands and hard-to-reach locations may require longer transit times. Exceptional problems may affect timings. Delivery indications are estimates; in the event of significant delays, we will inform you and provide assistance. The protections for non-delivery and the allocation of transport risk described below remain unaffected.
We generally use Bartolini/BRT, DPD group, and SDA/Poste Italiane. Charges are those shown before payment. Collection from the farm is free. For collection, wait for confirmation that the goods are ready and arrange an appointment.
Collection at the markets. Alternatively, you can choose free collection at one of the markets where we have a stall: Tuesday and Friday mornings in Acqui Terme (AL), at the farmers’ market, and Saturday morning in Calamandrana (AT), at the farm market. When ordering, you choose the market and your preferred date from those offered, which leave time to prepare the order; the market and date appear in the confirmation. If something unexpected, such as bad weather or the market being suspended, prevents us from attending on that date, we will let you know and agree another date or another delivery option with you. If you cannot come on the chosen day, write to us to arrange another one.
Unless a different deadline has been agreed, delivery takes place without unjustified delay and no later than 30 days after the contract is concluded. In the event of non-delivery, the rights under Article 61 of the Italian Consumer Code remain available, including termination and a refund where provided for. We bear the risk of transport arranged by us until physical delivery to you or a person you have designated other than the carrier.
If a parcel arrives damaged or contains incorrect products, contact us as soon as possible and attach photographs if available. Asking you to report the issue promptly helps us assist you and does not limit your statutory rights.
6. Right of withdrawal
If you purchase as a consumer, you may withdraw without giving a reason within 14 calendar days of the day on which you, or a third party you have designated other than the courier, take possession of the goods. For goods ordered together and delivered separately, the period starts upon delivery of the last item. Other starting dates and extensions provided for by law remain applicable.
To exercise this right, you can use the Withdraw from a purchasefunction, send an explicit statement to info@miscasale.com or write to our registered office. Neither registered post nor prior authorisation is required. The form below is optional. It is sufficient to send the communication before the deadline.
The online function allows you to enter your name, the order or goods concerned and your email address, check the summary and confirm withdrawal. Receipt is acknowledged without undue delay on a durable medium, with the content, date and time of the communication. Keep the acknowledgement.
7. Returns and refunds
After notifying us of your withdrawal, return the goods to Azienda Agricola Miscasale Società Semplice Agricola, Regione Miscasale 6, 14040 Montabone (AT), without undue delay and in any event within 14 days of the notification. The deadline is met if you dispatch the goods within that period. You bear the direct cost of returning the goods, unless otherwise agreed or where the law requires the seller to bear it. The legal guarantee applies instead to defective or incorrect products.
We refund payments received for the goods covered by the withdrawal and, if you withdraw from the whole order, standard delivery charges, without administrative penalties. We do not refund the additional cost of a more expensive delivery service you chose over the least expensive standard delivery available.
The refund is made without undue delay, within 14 days of notification of withdrawal, using the same payment method you used, unless expressly agreed otherwise at no cost to you. We may wait until we receive the goods or evidence that they have been sent back, whichever occurs first, unless we have offered to collect them ourselves.
You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, within the limits of the law. Use suitable packaging; the absence of the outer transport packaging alone does not automatically remove the right of withdrawal. This packaging must be distinguished from the seal on the food packaging, to which the exceptions in the following section refer.
8. Exceptions to withdrawal for food products
Food packs sold online are closed by heat sealing, food-grade adhesive or a security seal. For food supplied in sealed packaging that, once opened, cannot be returned for hygiene or health protection reasons, the right of withdrawal is excluded if the seal was opened after delivery, under Article 59(1)(e) of the Italian Consumer Code. For these products, a change-of-mind return therefore requires the food packaging to be intact and unopened. Opening only the shipping carton does not amount to opening the food seal.
9. Legal guarantee and complaints
The seller is liable for lack of conformity under Articles 128 et seq. of the Italian Consumer Code. You can request the remedies provided for, including replacement free of charge and, in the cases established by law, a price reduction or termination with a refund. Write to info@miscasale.com with your order details and the problem encountered.
For food products, the assessment takes account of the stated characteristics, shelf life and storage conditions: the guarantee rules do not imply that the product remains fit for consumption beyond its stated shelf life. Deterioration caused by incorrect storage after delivery must be distinguished from a defect already present on delivery.
10. Applicable law and disputes
Italian law, the Italian Consumer Code and other relevant mandatory provisions apply. Mandatory rules on jurisdiction are respected for consumers, including the court of their place of residence or domicile if located in Italy, and the protections provided for consumers in other cases. We do not impose exclusive jurisdiction at the location of the company’s registered office.
You can contact us to try to resolve a complaint. Applicable ADR procedures and recourse to the courts remain available; where required, if a complaint remains unresolved, we will provide information about the relevant ADR body and our participation. No clause limits consumers’ mandatory rights.
11. Personal data and updates
Data processing is described in theprivacy notice; cookies in thecookie notice. Acceptance of the terms of sale does not constitute consent to marketing or optional tracking.
Changes to these terms apply to new orders. For orders already concluded, the accepted version remains valid, subject to applicable mandatory obligations.
